Just noticed something that makes it imperative that we get this embargo lifted soon. I was looking at the fixture list for the coming months, and thought something looked odd about January. There are 9 games on!!! I thought the games against Whistable and Boreham Wood would be delayed until February. At the moment there are 6 games in February, and i can see that increasing because we haven't played in the LSC yet and i assume we'll beat Whitstable as well.

I keep reading we owe 20k, yet the club said we have 20k payable in due course (rumoured to be may 2011). If we are upto date OR not subject to a petition surely that embargo is lifted immediately. Weve paid the HMRC petition off, been deduccted 5 points, had a 5k suspended fine, what next make a rule we must start with 9 players?

Do we owe it or not? With NINE games in feb we need the embargo off at least to let Jamie sign a few on Dual forms or some such scheme where he can rest players. We need clarification as to WHY the embargo hasnt been lifted and whet we need to do EXACTLY to get it off.

I really cant see why it remains in place if we are upto date with HMRC. I hope to read clarification ASAP and this is vital for this season.

The embargo is still in place and rightly so, in my opinion. All the following is to the best of my knowledge but I don't believe it is far off the mark.

As has been stated elsewhere, PAYE/NI are paid monthly on the 19th; VAT is paid quarterly.

Since the beginning of last season the Conference has required its member clubs to submit quarterly financial reports. Part of these reports is to:
  • state that the club is up to date with both PAYE/NI and VAT and to provide proof of that; or
  • state the current situation and provide a written agreement with HMRC with regards to rectifying that situation.

Our winding-up petition was served sometime in June (possibly earlier) so the amount paid off on 15 December covers only that debt. To get the initial adjournment in August the club had to pay off the current tax year's debt i.e. that for April, May, June and July.

Presumably Welling United submitted false reports throughout last season, hence the five-point deduction. However, one would assume that once bitten... so the most recent report was hopefully spot on and thus included any PAYE/NI/VAT incurred since the 25 August and which is yet to be paid. If the club has no written agreement with HMRC with regard to these debts then the embargo stays until either it does have written agreement or the money is paid.

The big question is: has the club made any effort to obtain an agreement with HMRC?

Russ, is it your understanding that the Tax/NI and possibly some VAT relating to the period August to the present is still outstanding? At an estimated £1,000 a week this would give the figure of £20,000 which was mentioned as outstanding at the time of the appeal earlier this month.

sounds pretty plausible, lets hope a statement is made , the embargo coming off must be a huge priority now that the aggressive debt is gone. Lets hope they dont change embargo rules to non aggressive debt for next season.
