From the web site - things are happening

Notice to all fans who recently lent monies, via our solicitors Leathes Prior, in connection with successfully defended winding up petition.

As you will know, the Club wishes to appoint (amongst other appointments) a Lenders' Representative who shall represent the interests of those lenders that recently loaned monies to the Club.

That Representative will be responsible for (a) sitting on appropriate committees that will be formed as part of a new constitution of the Club, (b) acting as a liaison between the lenders and the Club in respect of the financial interests of the lenders and ( c) for overseeing the administration of the repayments due annually to the lenders.

Since it is anticipated that there may be a number of individuals who wish to stand as this Representative (and it goes without saying that in order to stand you must have been a lender), and to get the process moving, we would ask that anyone who wishes to stand for election as the Lenders' Representative notify Dan Chapman of Leathes Prior Solicitors (either by email on dchapman@leathesprior.co.uk or by post to Leathes Prior, 74 The Close, Norwich, NR1 4DR) by no later than Friday 21st January 2011.

In the event that there is more than one candidate, an election will be held or (only with the agreement of the individuals concerned) the candidates may decide to elect one of their number as the Lenders' Representative with the remainder forming a sub-committee to assist that Representative.

Now that I have re-read this I am concerned that if more than one lender wishes to be the rep then those who put their names forward will elect the rep between them. Surely a more democratic way would be a vote (postal if need be) by all those who lent money. I intend seeking clarification from Dan Chapman about this and if its only a vote between those who put their names forward I would urge all lenders to then put there names forward in the interest of total openess.

Your suggestion requires all lenders' identities to be revealed to the others. Some may have no wish to become the representative and would prefer to remain anonymous. Under the proposed system the identity of any lender putting their name forward would be revealed to the others when a ballot became necessary but by seeking election they would know this will happen if there is more than one candidate.

This announcement also confirms that the committee which the lenders' representative and the Supporters' Club Chairman will join is subsidiary to the Club's executive management committee and will have no direct say in decisions affecting the Club until after they are made. I would think the supporters and lenders deserve more than this.

Sorry my bad English, I did mean that a vote amongst all lenders should take place only if more than 1 candidate. Lenders would still remain anonymous if a postal ballot took place organised by either the solicitor or electorial reform society.

Perhaps I should have said "provides more evidence" rather than "confirms".

I do think that if you are expecting representation on the main Board of Directors or whatever it is called at Welling you will be disappointed. I may be wrong, of course.

Regarding Squarevanman's point I agree the Solicitors could ask each lender whether they wish to be considered as the representative. The identities of these would then become apparent to the other lenders when a voting slip is sent out if there are two or more candidates but lenders who are not on the voting slip would remain anonymous.

A very valid point - it must be if that if one of the lenders is to be the representative of the other lenders, then everyone should vote.
